1. Acceptance of Terms
These Terms and Conditions (“Terms”) govern your access to and use of Yathi Candle Studio and its website/application located at yathicandlestudio.com (collectively, the “Service”). By accessing, browsing, registering on, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, which constitute a legally binding electronic contract under the Indian Contract Act, 1872 and the Information Technology Act, 2000. If you do not agree, you must not use the Service.
2. Eligibility
You must be at least 18 years of age and competent to contract under Section 11 of the Indian Contract Act, 1872 to use the Service. If you use the Service on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate, current and complete information and to update it as needed. Yathi Candle Studio may suspend or terminate accounts that contain false information or are used in breach of these Terms.
4. Pricing and Payments
All prices are listed in Indian Rupees (INR) unless stated otherwise and are inclusive or exclusive of applicable Goods and Services Tax (GST) as indicated at checkout. You agree to pay all charges incurred through your account. Payments are processed through third-party payment gateways, and you authorise such gateways to charge your chosen payment method. We reserve the right to revise pricing with prospective effect.
5. User-Generated Content
You retain ownership of content you submit but grant Yathi Candle Studio a non-exclusive, royalty-free, worldwide licence to host, display and distribute it for operating the Service. You are solely responsible for your content and must not post anything unlawful, infringing, or in violation of the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. We may remove content and report it to authorities as required by law.
6. Intellectual Property
All trademarks, logos, text, graphics, software and other materials on the Service are the property of Yathi Candle Studio or its licensors and are protected under the Copyright Act, 1957 and the Trade Marks Act, 1999. You are granted a limited, non-transferable licence to access the Service for personal or internal business use. No content may be copied, reproduced, or exploited without prior written permission.
7. Prohibited Use
You agree not to: (a) use the Service for any unlawful purpose or in violation of these Terms; (b) attempt to gain unauthorised access to any system or data; (c) transmit malware, spam, or harmful code; (d) infringe the intellectual property or privacy rights of others; or (e) engage in any activity that disrupts or interferes with the Service. Violations may result in suspension and legal action.
8. Third-Party Links and Services
The Service may contain links to third-party websites or integrate third-party services. Yathi Candle Studio does not control and is not responsible for the content, policies, or practices of any third party. Your use of third-party services is governed by their own terms.
9. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, except those that cannot be excluded under applicable Indian law including the Consumer Protection Act, 2019. Yathi Candle Studio does not warrant that the Service will be uninterrupted, error-free, or secure.
10. Limitation of Liability
To the maximum extent permitted by law, Yathi Candle Studio shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total aggregate liability for any claim shall not exceed the amount paid by you to Yathi Candle Studio in the three (3) months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be excluded under Indian law.
11. Indemnification
You agree to indemnify and hold harmless Yathi Candle Studio, its directors, employees and agents from any claims, damages, liabilities, and expenses (including legal fees) arising from your breach of these Terms or your misuse of the Service.
12. Grievance Redressal
In accordance with the Consumer Protection Act, 2019 and the Information Technology Act, 2000, complaints regarding the Service may be addressed to our Grievance Officer at yathicandlestudio@gmail.com. We endeavour to acknowledge complaints within 48 hours and resolve them within a reasonable timeframe.
13. Changes to Terms
Yathi Candle Studio reserves the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised “Last updated” date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
14. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of India. Subject to the arbitration clause below (if applicable), the courts at Guntur, Andhra Pradesh shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms. Any dispute shall first be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996, with the seat and venue of arbitration at Guntur, and proceedings conducted in English.
